Terms of Service

1. Agreement to Terms

By accessing focusstreammedia.com or engaging FocusStream Media ("FSM," "we," "us") for services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our site or services.

2. Services

FocusStream Media provides professional audio streaming, remote live mixing, FSM Node hardware deployment, and post-production content services for churches and faith-based organizations. The specific scope, deliverables, and pricing for each engagement are governed by a separate service agreement executed between FSM and the client organization.

3. Implementation Fee

The $1,500 implementation fee covers FSM Node hardware delivery, remote signal chain calibration, 24-month hardware warranty, and the first 30 days of technical support. This fee is non-refundable once the FSM Node has shipped.

4. Client Responsibilities

To receive services, clients agree to:

• Provide accurate information during the intake and onboarding process
• Maintain a suitable network environment as specified during the audit call
• Designate a point of contact for technical coordination
• Pay invoices within the terms specified in your service agreement

5. Intellectual Property

All sermon recordings, transcripts, and content assets produced by FSM from your services remain the property of your organization. FSM retains ownership of its proprietary software, signal processing technology, and the FSM Node firmware. You may not reverse-engineer, copy, or redistribute FSM technology.

6. Service Availability

FSM targets 99.9% uptime for remote mixing services. Planned maintenance windows will be communicated at least 48 hours in advance. FSM is not liable for outages caused by your local network environment, third-party streaming platforms, or force majeure events.

7. Limitation of Liability

To the maximum extent permitted by law, FocusStream Media's total liability for any claim arising from your use of our services shall not exceed the fees paid by you in the three months preceding the claim. FSM is not liable for indirect, incidental, or consequential damages.

8. Termination

Either party may terminate a service agreement with 30 days written notice. FSM reserves the right to suspend services immediately for non-payment or material breach of these terms. Upon termination, all content assets and recordings remain available to you for 90 days for download.

9. Governing Law

These terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

10. Changes to Terms

We may update these terms from time to time. Continued use of our services after changes constitutes acceptance. We will notify active clients of material changes by email.
